bErlin (dpa)Berlin prosecutors initially do not accept the verdict against the former manager of rapper Bushido. The authorities filed the appeal “for verification purposes,” an official said Monday in response to a request from the German Press Agency. Whether this actually happens depends on the written reasons for the decision. It will likely be several months before this becomes available. However, an appeal must be filed within one week of the verdict.
A Berlin regional court acquitted Arafat Abu Chaker, considered the head of the Berlin clan, on key issues last Monday after a trial that lasted about three and a half years. He only sentenced the 47-year-old man to a fine of 81,000 euros (90 daily bets of 900 euros each) for violating the confidentiality of speech by secretly recording conversations.
Compensation for imprisonment of two accused
Three accused brothers, aged 42, 46 and 53, were also acquitted in the Bushido cases. One brother was not punished for perjury. According to a government official, prosecutors refrained from appealing his case.
According to the verdict, Arafat Abu-Chaker will receive compensation of 75 euros a day for a good two weeks of pre-trial detention, while his 42-year-old brother will receive about eight months. Given the acquittals, each will have to pay only a fraction of the huge legal costs. The rest goes to the state treasury.
Rapper Bushido was a witness and co-plaintiff in the criminal trial – and a large part of the charges were based on his statements. After this, after the separation of former business partners in 2017, violence allegedly occurred in order to extract a million-dollar payment from the musician. Prosecutors charged Abu-Chaker with, among other charges, attempted aggravated extortion, deprivation of liberty, coercion, grievous bodily harm and serious breach of trust.
However, in its decision, the regional court made it clear that it was not convinced by the testimony of Bushido, whose real name is Anis Mohamed Ferchichi. There are contradictions. The verdict stated, among other things, that attempted extortion was excluded for legal reasons. Abu Chaker could make a claim. Negotiations on the separation lasted several months. It cannot be assumed that the former manager had no claims regarding payment. According to the court, the fact of deprivation of liberty could not be proven. It was said the chamber also failed to form a conviction required for a conviction for causing dangerous bodily harm.
