DAmerican biotech company Promosome believes its patents are infringed by billions of coronavirus vaccines sold from manufacturers Moderna, Pfizer and Biontech. The companies failed to give Promosome what it deserved for developing breakthrough technology, Promosome’s attorney said on Tuesday (local time) while filing a lawsuit in San Diego federal court.
Vaccine makers have copied technology developed by Promosome that allows mRNA to be produced at doses low enough to be used safely and effectively in vaccines, the statement said. Promosome takes part of the fee. Moderna, Pfizer and Biontech did not immediately respond to requests for comment on the lawsuit.
American pharmaceutical giant Pfizer made $37.8 billion last year from the Comirnaty Corona vaccine developed in partnership with Mainz-based Biontech. Moderna made about $18.4 billion from the Spikevax vaccine. In the lawsuit, Promosome claims it met with Moderna between 2013 and 2016 to discuss licensing its technology.
The American company also demonstrated the technology to a senior researcher at Biontech in 2015. According to the company, based in San Diego and New York, there is no licensing agreement with either of the two manufacturers.
Moderna, Pfizer and Biontech have all denied infringement of other patents in the past.
